Basically.. they're suing through a inter-state corporate trade law... that says that what's legal in one state... implies it's legal in another...

So, because there's no deposit scheme in other states... SA is exempted as it had it's scheme in place before the legislation... they claimed the NT law imposed a different trade "barrier"... to their product...

And the court also found that Coke was selling... not just the container... but the contents of the container...

Hence, the 10cent cost... was a price imposition on the product as a whole... that didn't apply in other states.... which meant that Coke's product was disadvantaged in the NT... compared to other states...
Who gives a sh!t what Coke thinks, or demands!... the governement is able to change tax laws and apply them retrospectively and that stands up in the high court against massive class actions, so surely, if this government was as serious about the environment as they claim, they could legislate a national deposit scheme and get the same tax lawyers they used to dot the i's and cross the t's on this new legislation and make it just as water tight.

Of coarse they could, but polititians are weak.
I think we all know corporations rule the government these days, dont forget a hell of alot of polititians ran/ have large investments in corporate australia.

One good aspect of the internet, allowing people to voice their opposition and start acting in ways that will make the company stand up and listen.

This sort of thing is going to cause a huge problem for them. they make no sales because no one will put their money into a machine that's out of order. Then they will have to send someone out, only to find that the machine is fine..

Yeah it does make me cringe a bit, because it's a bit wrong, but then not half as wrong as what they do, not only in this court action, but also in the pressure they are putting up against a national plan.

We shouldn't lose sight of the fact that Schweppes and Lion Pty Ltd also fought this case alongside Coca Cola Amatil.

Products are listed here: http://ccamatil.com/OurBrands/Pages/Australia.aspx
here http://lionco.com/brands/dairy-and-drinks/
and here http://lionco.com/brands/beer-spirits-wine/ http://www.schweppesaustralia.com.au/Our-Brands.aspx

Complaints could be sent directly to the companies via these sites, if boycotting products doesn't work for you.

I think you will find its Constitutional Law (even though I have not checked the case out), The fault lies with the other States; impose the return scheme equally and they would not have a leg to stand on.
There have been a number of people trying to get it in WA, but if you want to do it convince NSW and Victoria.

Most humorous EB :)
While the Constitution recognises heads of power and Corporations and Banking and Trade, it does not recognise individual rights; that it was assumed would be covered by Common Law; which is slowly being eroded. :bootyshake:

Careful, supervege might catch wind of this thread... I have not bought a coke for drinking in many many years. In fact I can not remember exactly when it was. I did buy a bottle about two years ago, I needed a rust remover. I did not drink any though. I prefer to keep the phosphoric acid on the rust, not in my belly.

I'm thrilled to see this community is "awake" to the nonsense out there. I found this community trying to escape the poisons of this world and create an alternative. A message must be sent to corporations. I feel there will be drastic changes to the way we all live in the next 5 years with how many are realizing what's going on around them.
