Yeah... still waiting for a call back from the "claims dept"..., after having been transferred twice and placed on hold.. only to ultimately be told by a pre-recorded message that...

"nobody is currently available to handle your call... please leave your name and number and we'll contact you as soon as possible"....

Now been two days....

So, having called Integral/Origin three times... to find out how to lodge a claim...

I get a call back from the claims department.... of "Endevour Energy"....

Well not funny really... they are obviously suggesting that the fault lies with Integral/Origin...

Dont stand for any of this finger pointing Rup. Make it known that one or the other will be paying for your losses and that your solely pointing the finger at the party immediatly responsible for your losses (ie: intergral for pullling the plug) that way they know the ounus is on them to either find the other guilty or be held responsible. And have you contacted small claims or a lawyer. A letter on a letterhead from a legal firm often gets results.

Yeh... but a letter from a sand shark will probably set him back about 250 clams... walking into their head office with half a dozen rotten trout in a box as "evidence" will cost nothing... but it'll probably get instant results...
They'll be bending over backwards to get him outa there! :thumbright:

maybe you should point out their responsibilty or duty of care to customers.their actions have resulted in the death of 100s of livestock and when that is directed back at them or an indivdual working for them their attitude can change quickly.
No one wants that sort of responsiblity thrown at them especially publically

very true, when you put it in that term, livestock, it sounds a lot more shocking than the death of a few fish.

Well after nearly 8 weeks... I finally have a response from Integral yesterday...

They've actually sent out a "without predjudice" claim form.. asking for details of the claim...

To be returned in 14 days... of course the letter is dated 7 days before I actually received it...

On another note... once I got back from Canberra, I rang Suncorp in QLD.. the lady at faults insurance company... only to find out that she only has basic third party cover... not damage cover...

Got a quote from the local smash repairer to fix my car... and sent it off to her email...

Heard nothing for a week, so called her... no answer... she texted back yesterday that she wasn't available until today...

I rang.. no answer.. left a message... and she finally rang back...

I asked if she had received the email and attached quote... "oh, haven't checked my mail for days"...

She said she'd forward it to her insurance company... so I told her that I'd already contacted them, and that she wasn;t covered for damage...

She said, as I suspected.. that she didn't have that kind of money ($2400)... and that if she did.. she wouldn't have been in Canberra.. and the accident wouldn't have happened...

I didn't say it... but I was thinking... "If you'd told me that you were going to be in Canberra.. and would run into me".... "then I would have made sure I wasn't bloody there either"...

Haven't got the letter as yet... but Integral Energy has apparantly made me an offer... to the value of the stock lost....

Wouldn't come to the party as far as replacement stock/feed.. or loss of goodwill to the business...

But it's a start I guess...

Have you written in this thread what you estimate your losses to be Rup? Including eaten feed, stock, power and water usage etc..
It will be interesting to see how there offer compares

Basically they're offering market value of stock loss only Bundy... 100kg of trout @ $20/kg = $2000

I haven't actually received the letter yet to see what they've said in relation to other items I claimed... but by phone it was suggested that any costs to replace stock and feed, power/water and my time to grow out... were costs that I would have incurred anyway for a new batch....

I suspect that the same arguement would be advanced as to costs incurred during the grow out process... i.e that the market value represents, and is inclusive of costs incurred..

$20 p/kg for trout that's pretty cheap for market value isn't it?

It's about an average between whole fish ($18-$22) and smoked ($22-$24) market value as per the Sydney Fish Market... didn't want to be too greedy...

better than a swift kick in the teeth i'd say rupert. glad you at least got something back

and I must have missed the thread about your car. I assume she only has ctp, so therefore is essentially un-insured? if she has any real third party insurance it should cover the cost of your repairs. I hate that we have people driving around uninsured, its so rude. send her an invoice, when she wont pay, go to one of the cheap and dirty recovery lawyers, and make her pay.
