I love the copyright on their site:

Quote:
(c) 2009 | 2011 Backyardaquaponicssystem.com. Aquoponics System and Backyard Aquaponics

Both Aquoponics System and Backyard Aquaponics are links to their site. It is made to look like BYAP is part of it.

Copyright is implied. But an auto watermark which makes it impossible to crop would be great. I would easily agree to that.

I think I've emailed about twenty of these ameoba affiliates... Come on Mr. Fay... if you want to claim any sort of credibility and sincerity... pull your affilates into line...

And get them to either use images with authorisation and credit.... or post photos of your actual systems....

But then.... you don't actually have any systems ... do you Mr. Fay...

What is an "organicle" and how do you get a complete one?

On the bright side, they're making up their own words and not using other people's!

Well, had a couple more emails from "John Fay", well someone, John Fay is a pen name. Strange, on their website it's claimed that John Fay is a certified organic farmer and aquaponics expert. So yeah, pen names might be legal, but is it legal to make false claims about the pen name?

I've had to remove the image of theirs from my article, and they have said that I can't use the term aquaponics 4 you because they have trade marked it. I'm waiting for them to send me details about the trademark, as I'm pretty sure they can't stop someone talking about them, so long as it's not being used in a commercial sense.

He says "I don't know if you are experienced in legal issues, but you cant legally claim that company abc is better than xyz - especially if company abc is your own." You prove legally that it's not... :)

Quote:
you are only trying to make our product look bad to advertise your own free manuals - which are not really free because they are used to lure people to buy aquaponics material. Which is to make profit like everyone else, nothing wrong with that, but you should not try to sound like you are doing this for the shake of humanity and aquaponics (and for free) - everyone have to eat after all!

Looks like he's caught me out, I'm just in it for the money..... :dontknow:

Anyway, at the end of the day, his final comment seems to be that it is not his responsibility to ensure people selling his manual are doing so legally, it is up to myself or others to contact him when these people are found, then he will act accordingly.

My final stand on the matter is that if he can't take any responsibility for the actions of the sellers of his products, and expects others to monitor them and let him know when they are making false claims and using pictures illegally. Then it will be up to him to monitor myself and others to ensure that we aren't making false claims about him and the affiliates selling his goods. :)

And I guess I'll just have to make more and more noise about a) how poor the product is. and b) how badly their resellers act.

What you mean that "Mr. John Fay" is not his real name....

He's so sure of his dodgey product... that he has to assign a dodgy name to it.... not his real name....

Well that makes sense....

Sorry Mr John Fay.... but you look and act like a dodgey person IMO...

And the aquaponics4u manual is a second rate publication in my view.... and employs a dodgey affiliate marketing model to promote it... even if such a model is legal...

I believe the aquaponics4u manual is a con and the people behind the manual use images of other people and state that John Fay built the systems in the pictures.

aquaponics4u
dodgy
con artist
illegal
using pictures without permission
google search John Fay
google search aquaponics4u

***This is my personal view and opinion. Nothing in this post may be construed as the view of BYAP***

Hopefully the internet search crawlers pick this up and spread the word.

Now here's a question....

How can Mr John Fay.... a pseudonom... claim legal protection... for comments made against his pseudonom...???

How can a "fictious" person claim to be the subject of libel or slander...

Especially when the pseudonom itself makes ficticous claims as to being an "organic gardener"... and an "expert on aquaponics"....
