Hey folks, i left my last employer early august and have still not received a Group cert. I asked for it as soon as the 08/09 financial year ended, got told a week, never got it.. have asked over a dozen times since and still nothing. Got told " we overpaid tax on wages and want to claim that back before we do our other things" that has nothing to do with my summary...
any ideas what can be done?? ATO says fill out a stat dec and go do my tax, but i am not an accountant and if there is something wrong with my paperwork then it all falls onto me. My accountant says way too hard and risky to do stat dec, and i should keep asking... but i a getting sick and tired of it.... ATO should man up and fine them.. thoughts?? anyone else going through this???

Tried the prefill system in etax? It may already have the data.

Edit: Overpaid on taxes is an excuse, all that would happen then is you would get a bigger refund.

Fill out the stat dec that says employer did not provide then it becomes their problem.

Keep on them. It's not really been that long. I ident to ever get mine prior to September, and you've got until next June really to lodge...
If they've not done it by Xmas I'd go looking for somebody with a big stick.
Is this a little firm or big?

Not sure if it would help but maybe try approaching DOCEP (Department of Consumer and Employment Protection)... Although not employment related, but it is part of the company's responsiblity as an employer to provide you with a group certificate so you can get your tax done... From July to September, now coming October should be more than enough time to provide the information...

I would try the Prefill as Privateer recommended although I had a stint at a garden nursery and it never came up automatically.Had to put it in manually

The only other thing i can think is that there has been something dodgy done with wages and tax etc so my forms could bring something crashing down maybe?? at the emd of the day i was the only employee... just the boss, and myself, thats it, not like he had 50 to do.. will ring the ATO again tomorrow and see if they can get a rocket up him.. although the last phone calles ended in them all saying do the stat dec. and i realise i could do it. BUT its now the principle of it. someone is not doing their job properly and it irritates me. last year i waited 4 months.. the year before..... 48 weeks!!!! not doing that again.

oh yeah.. and no super contribution for over 12 months i found out too.. but it is listed on my pay slips..

Oh... I think legally the employer can only delay it for a few months... after that, I think they are breaking the law...

Come to think of it, your employer may not have provided the withheld tax to the tax dept, hence he cannot provide you with a group cert, because that will spill the beans...

It could be intentional. It does not surprise me that it is such a small firm. This year is the first year in the 6 I have worked for this small firm that I got my GC in July!
If he's a decent bloke then hasselling him will work. the tax office will screw him eventually otherwise. The ATO is a lot more lenient than a lot of ppl think, so he'll have to be later than June next year to raise their ire.
Just keep calling him every Monday.
Was he an alright sorta fella? Or the blatently shonky type?

Regarding super... that is dangerously common - an the cause of most enormous company crushing debts. You should shoot your super fund. Mine rings up threatening to have legal ppl fall upon my boss if he doesn't pay within a week of the due date...
The lack of super being paid will be highlighted when the GC is submitted. He's likely shitting himself. But as I said, the ATO is lenient, and offer good payment plans.

I thought he has till october sometime to do group certs. at least that what my boss tells me . they have a date to do it by or they get fined/charged, same with super he can get charged if he has'nt done the contributions, I have heard that some employers pay the lot once a year instead of progressively, that is legal apparently but you will miss out on interest, if it's done that way, He wants to be careful coz the ATO are cracking down this year, A blitz they call it, first time in 20yrs. I had a discussion with a guy from the ATO when I did my Tax last month. so best of luck, Employer is the one who will get in the @#$! its his responsibility.

Employers have obligations... Its not your problem, state what should have happened and let them do the leg work to work it out....
