Here's a thought...

As far as I am aware, Aquaponics is not a word in the dictionary... It is really a nickname sort of word...

Which means, it can be registered as a name like McDonalds...

So if someone owns the name "Aquaponics"... and if these crazy fools get their patent approved as "Aquaponics System"... wouldn't the person who owns the name "Aquaponics" have a claim against someone using the word "Aquaponics"??

Nah can't patent a chemical action.
Design might work but there are many they haven't mentioned like a curled edge for stiffening Gb's
Ribs x number etc.

They have a hide but I wish them luck,we are trying to get some patents certified at present and it is a can of worms .Patent eternys tend to lead you along like a bird doing the broken wing act and after they have all your money tell you it can't be done.One problem if the Chinese decide to make it then you have to sue the individual but while your doing that there is another twenty doing it so if you win then you have to then take on the other twenty.So as I see it thats what it would be like for them .They would have to deal with a lot of people and $100,000 doesn't go far when you start to go to court.For all that they should be taken seriously because I have seen some smart ars take out a patent on something that someone had been making for years and get away whith it.
In our case they are rejecting the patent because they say it is the same as others that have been registered even though it will do several important things that the others will not.

As I understand these things. Joel is doing the right thing by sending the info off to the lawyers as I suspect if these guys get their patent, Joel and the others that have businesses selling aquaponic systems are the ones gonna have the most trouble with them.

Mind you I think trying to patent natural processes is wrong!!!!! But that doesn't mean that authorities or courts will agree with me. Heck, there are people who have patents on genes (as if they invented them! they only discovered a particular one!)

They may grant it, but if it ever goes to court, it'll get overturned because there is "Prior Art" - I saw Joel on Gardening Australia (which ABC will have a record of) back in 2006, so there is prior art right there. Plus you can write to IP AUstralia and let them know that this one is bogus.

I doubt it. The term is a description. It would be impossible to trademark. It'd be like trademarking "Fresh Beef" or "Greengrocer" or "Post Office"

You need to be the first to use the term in order to trademark it.

Too many companies already have aquaponics in their names. Surely the lack of it being in an independant dictionary wouldn't effect this.
Besides, it's in wikipedia, that's surely a dictionary of sorts?

You can still trademark aquaponics terms, we have the term "backyard aquaponics" as a registered trademark under 4 different categories, sales of kit systems, information products, etc, etc. Martin in Qld has trademarked "aquaponics man" (not sure if that's a new super hero) under at least one category.

Our application got knocked back to begin with, we had to supply documentary evidence that the term had been used for a long time and that it was intrinsically used as a term to describe our specific business and products. It wasn't a simple or cheap thing to do...

I don't imagine that this patent application has been cheap either, and I understand why they were trying to raise capital now.. But yes, I do believe that in 2006 I explained on national television in a bit of detail about my vertically stacked barrel system that had worms breaking down wastes as well as aquatic species and plant species.. :D

A patent is only granted after a successful inspection.
Most patents are granted because nobody objects to the patent.
Anyone objecting puts the case against the patent and it either is approved or not approved.
Guys, LODGE an objection NOW.
There is a fair chance that the patent attorney is sucking the applicant and as stated will say at the last minute it cant be granted, too late he has got your money,.....,

Also forgot to add, you cannot patent anything once it has been viewed by the public and a commercial sale has been made.
That sort of shoots the whole patent idea up the b...Unless we are not making commercial sales???
