This IS what is being discussed here...

You'll probably find that everything... to some degree or other... is already enacted in your laws...

Let's see if they give the small farmer(grower) equal representation on this, or even if able to focus as one voice before this is passed. Will price us into non-existence it seems if each crop grown has to recorded, logged and detailed for inspection. I'm not liking the sound of this at all.

I say again... there are valid concerns regarding the "extent" or "definitions" within the bill...

My original posts opposed the idea that it was some sort of "leftist" plot... or a personal agenda of Obama ... or the Obama administration...

In susbsequent posts ... I pointed out that public food safety laws are commonplace in most countries... and are usually very stringent... even if not imposed to the enth degree... unless a food poisoning outbreak occurs.....

And that a worldwide approach to standardisation of legislation had been in progress for decades.

I'm sure that their are countries... like say... perhaps Outer Mongolia, the highlands of Papua New Guniea, Botswana....

Where food safety laws may not exist to the same extent... or be enforced at all....

But I'd be very surprised if South Africa did actually have some quite stringent laws enacted.... even if not actually enforced...

Haven't actually read through the "acts" yet Cyara... but...

WHO IS RESPONSIBLE FOR FOOD SAFETY AND FOOD QUALITY LEGISLATION IN SOUTH AFRICA?

The following national departments are the main parties responsible for food legislation:
1) The Department of Agriculture
2) The Department of Health
3) The Department of Trade and Industry


HOW ARE THEY INVOLVED IN THE PROTECTION OF THE CONSUMER?

The Department of Agriculture regulates safety and quality of agriculture and animal products in terms of the Agricultural Product Standards Act, 1990.

The Department of Health requires that all foodstuffs shall be safe for human consumption in terms of the Foodstuffs, Cosmetics and Disinfectant Act ,1972 (FCD Act). This Act addresses the manufacture, labeling, sale and importation of foodstuffs. Matters regarding the hygiene of foodstuffs are addressed by the National Health Act, 2003, and the hygiene requirements at ports and airports including vessels and aircraft are addressed by the International Health Regulations Act, 1974.

The South African Bureau of Standards (SABS) falls under the jurisdiction of the Department of Trade and Industry and controls canned meat and frozen and canned fishery products through the Standards Act, 1993.


HOW AM I PROTECTED AGAINST CONTAMINANTS AND TOXINS IN FOODSTUFFS?

Food legislation is based on the presumption of safety. Where a substance is not naturally present in a food e.g. an additive or contaminant, maximum limits are laid down which in many cases are those determined by Codex Alimentarius.

The Foodstuffs, Cosmetics and Disinfectant Act (FCD Act) is considered to be a reactive Act which means that approved and acceptable sources are taken in to account to provide the information on safety of foodstuffs for regulatory purposes. These sources include:

Codex Alimentarius standards and guidelines
The Fertilizers, Farm Feed, Agricultural Remedies and Stock Remedies Act, 26 of 1947, which set out regulatory requirements for registration of pesticides and stock remedies
The Medicines and Related Substances Control Act 65 of 1963, which gives sets out regulatory requirements for registration of veterinary medicines.
The Genetically Modified Organisms Act 15 of 1997, which sets out regulatory requirements for foods from genetically modified organisms.
The abovementioned Acts are pro-active, which means that government approval must be obtained for the release of a product on the market. Assessments are required of the data and information submitted by the applicant to determine the risk. These assessments are conducted by a group of independent experts or government officials trained to do so.

in terms of the Act. A list of the regulations in question is included under Annex B.
An extensive set of regulations related to the handling of food: The Regulations Governing
the General Hygiene Requirements for Food Premises and the Transport of Food (R. 918),
were published by the Department of Health on 30 July 1999. These regulations are
applicable to all food handling situations, including restaurants, café’s, shabeens, taverns,
caterers/suppliers at special events etc., and covers the following important aspects related to
the requirements for the handling of food:
- Prohibition on the handling and transport of food
- Standards and requirements for food premises
- Standards and requirements for facilities on food premises
- Standards and requirements for food containers
- Standards and requirements for the display, storage and temperatures of food
- Standards and requirements for protective clothing

- Duties of a person in charge of a food premises
- Duties of a food handler
- Standards and requirements for the handling of meat
- Standards and requirements for the transport of food
- Provisions concerning unprocessed products
A certificate of acceptability issued by the relevant local authority is required before food can
be handled by any person, including those involved in food handling at special events. The
owners or persons in charge of such premises are advised to contact the Environmental
Health Services of their respective local authorities for assistance and further information
regarding the mentioned certificate, as well as on any other health requirements for the
handling of food included in the above-mentioned legislation.
