Found it! The guy is a thief! Too bad they didn't correct him the first time he got caught. (Something about the old Arab punishment of cutting off the right hand seems fair in this case.) Over here, he would be facing the loss of the money that was recoverable (what he hadn't spent already) a few years imprisonment on the violation of the Fair Trade laws, and a few on filing a fraudulent bankruptcy case. Then, if he did any of his business through the Post, he would be facing Mail Fraud charges, and if he did any via the internet some more for "wire" fraud. In all probably at least ten or fifteen years, unless he got a tough judge who wanted to give him maximum sentences on each charge, each to be served consecutively! Kevin |

At least ASIC froze his account when he made the bold step of transferring a few mill from the company account to his personal account. The must have already had their eye on him. i reckon the next step would have been a one-way first class to a non extradition treaty country

The transaction would have been reported by the bank as a suspicious transaction I suspect. Would have been a requirement to report the transaction to Austrac. Mind you - you are probably right Steve in that ASIC may well have had him on a watch list. |

i am not involved but feel that the old man is about to get screwed like this. He is getting a 3000l slimline tank and was told it would be 12 weeks and now cannot contact the guys he paid the deposit to. Am very worried. They also paid considerably more for the slimline steel tank than the poly ones you can get. |

mum and dad were about to part with $1300 for a 2KL slimline side of the house job. i told them to get 2 IBC's for $240 LOL |

Nick, You may need to help him follow up, could be another scammer, or it could be a legitimate problem (death in family, illness, vacation and problems with production/demand.) My big worry would have been when they told him it was going to be 12 weeks for delivery and the amount of the deposit. (If the deposit was small, then I wouldn't sweat it, but if they wanted half or more...). Good luck. Kevin |

Yeah Nick, chase up the ppl involved, I have had a similar experience where the retailer accepted my deposit then didn't bother to fax the order through to the manufacturer - rang the manufacturer direct and got prompt action when I presented all the facts. |

Nick - my wife's olds are currently taking one mob to small claims tribunal. After several promised delivery dates did not happen, they purchased a tank from elsewhere and asked for their deposit back. The mob refused to give it back claiming breach of contract. Very silly people, there is no chance that they will get away with that. It is just a shame that businesses that lose in small claims are not published in the newspaper, like they used to be years ago. |

Kevin Kevin, the problem at the moment in the Brisbane area is that it is in severe drought, everyone is being encouraged to buy rainwater tanks, and all the manufacturers are working non-stop (opening new factories etc). There is a long waiting list from what I understand. |
