Yea I spoke to John again to clear a few more things up and basically as you say Gavin is that the documentation is so old its not really set up for the backyard aquaponisist (is that a word) and it is the destination of the fish is what they are interested in and that is what the fisheries dept is working on - they are working on aquaculture legislation and that will then stem down to the non - commercial backyard stuff.

The thing is these guys are now aware of the growing AP industry and are working on legislation that will streamline strategies to cope with the amounts of fish moving around. Their concerns lay with the movement of healthy fish that will not be detrimental to our waterways or any given species which is definitely a good thing.

The best thing I could take from what they are doing is what they call a "white list" - it is a list of species that will be considered acceptable to relocate within australia without stringent scrutiny. Silver perch was mentioned. It will simplify things and benefit the AP industry due to high levels of fish movements.

They realise that AP is a controlled environment to house fish (when stored in tanks, not ponds) and if it came to the crunch you would have a good case if you show you are doing the right thing.

End of the day andrew is right, nothing is in writing and my only intentions are to share information that I was given so (backpedal) my recommendation is for the mean time - fill out the form and you are legally protected.

I suppose does this approval apply retropectively. ie for example silver perch bought from last year but will still be in tanks for 1-2 years more?

Sorry Matt but my computers playing up and although I updated the website it wont upload correctly so the link to the translocation form isnt coming up.
I'm picking up a new machine next week so will get it up on there soon (hopefully).

Hmmm. Have a spare tank for the trout but as the other has SP the numbers will not be changing much as the SP are 250-350gm. So only a small order i think,

If you want to do everything by the book you should be getting translocation approval for any fish that are moved onto your property. As I said before you only have to fill out the form once and then you can just renew it every year you want to get more fish. There is no charge and if everyone did it then Fisheries would have some idea of the number of people doing aquaponics and the demand for fish. I think that this can only be a good thing and may enable us access to new species in the not to distant future.
What I am hoping will happen when the new Translocation Policy comes out is that species on the 'White List' like Silvers, Trout and Barra wont require any approval. I am then hopeful that other species may be allowed but with prior Translocation Approval.

I got a translocation approval earlier this year to move trout. It took a few weeks to come through but it didn't cost anything other than a bit of my time. Gov dept's love their paper work. Just fill in the form, get your bit of paper and you're covered.

To save a bit of time and hassle, it's a good idea to get the approval for more fish than you would expect to be getting as the approval is valid for 12 months. You could get an approval to move say 200 fish. You could then move 100 early May 2012 and the other 100 end of April 2013. Then you'd only need to get one approval for 2 years worth of fish.

But by then the rules would have probably changed several times over.
